According to the view that there is moral encroachment in epistemology, whether a person has knowledge of p sometimes depends on moral considerations, including moral considerations that do not bear on the truth or likelihood of p. Defenders of moral encroachment face a central challenge: they must explain why the moral considerations they cite, unlike moral bribes for belief, are reasons of the right kind for belief (or withheld belief). This paper distinguishes between a moderate and a radical version of (...) moral encroachment. It shows that, while defenders of moderate moral encroachment are well-placed to meet the central challenge, defenders of radical moral encroachment are not. The problem for radical moral encroachment is that it cannot, without taking on unacceptable costs, forge the right sort of connection between the moral badness of a belief and that belief’s chance of being false. We often speak as if there are merely possible people—for example, when we make such claims as that most possible people are never going to be born. Yet most metaphysicians deny that anything is both possibly a person and never born. Since our unreflective talk of merely possible people serves to draw non-trivial distinctions, these metaphysicians owe us some paraphrase by which we can draw those distinctions without committing ourselves to there being merely possible people. We show that such paraphrases (...) are unavailable if we limit ourselves to the expressive resources of even highly infinitary first-order modal languages. We then argue that such paraphrases are available in higher-order modal languages only given certain strong assumptions concerning the metaphysics of properties. We then consider alternative paraphrase strategies, and argue that none of them are tenable. If talk of merely possible people cannot be paraphrased, then it must be taken at face value, in which case it is necessary what individuals there are. Therefore, if it is contingent what individuals there are, then the demands of paraphrase place tight constraints on the metaphysics of properties: either (i) it is necessary what properties there are, or (ii) necessarily equivalent properties are identical, and having properties does not entail even possibly being anything at all. It is widely agreed that hypocrisy can undermine one’s moral standing to blame. According to the Nonhypocrisy Condition on standing, R has the standing to blame some other agent S for a violation of some norm N only if R is not hypocritical with respect to blame for violations of N. Yet this condition is seldom argued for. Macalester Bell points out that the fact that hypocrisy is a moral fault does not yet explain why hypocritical blame is standingless blame. (...) She raises a challenge: one must explain what is distinct about hypocritical blame such that the hypocritical blamer lacks the standing to blame, even if the arrogant or petty blamer does not. Of those writing on hypocrisy, only we offer a direct response to Bell’s challenge. Recently, however, our account has come under criticism. We argue here that (1) our account can handle these criticisms and that (2) no other rival account adequately addresses Bell’s challenge of explaining what is uniquely objectionable about hypocritical blame. Because answering Bell’s challenge is a necessary component of any plausible account of the relationship between hypocrisy and standing, our account remains the best on offer. (shrink)

An argument going back to Russell shows that the view that propositions are structured is inconsistent in standard type theories. Here, it is shown that such type theories may nevertheless provide entities which can serve as proxies for structured propositions. As an illustration, such proxies are applied to the case of grounding, as standard views of grounding require a degree of propositional structure which suffices for a version of Russell’s argument. While this application solves some of the problems grounding faces, (...) it introduces problematic limitations: it becomes impossible to quantify unrestrictedly over the relata of ground. The proposed proxies may thus not save grounding, but they shed light on what exactly Russell’s argument does and does not show. (shrink)

This article explores the connection between two theses: the principle of conditional excluded middle for the counterfactual conditional, and the claim that it is a contingent matter which (coarse grained) propositions there are. Both theses enjoy wide support, and have been defended at length by Robert Stalnaker. We will argue that, given plausible background assumptions, these two principles are incompatible, provided that conditional excluded middle is understood in a certain modalized way. We then show that some (although not all) arguments (...) for conditional excluded middle can in fact be extended to motivate this modalized version of the principle. (shrink)

As many studies around the theme of ‘too much medicine’ attest, investigations are being ordered with increasing frequency; similarly the threshold for providing treatment has lowered. Our contention is that trust is a significant factor in influencing this, and that understanding the relationship between trust and investigations and treatments will help clinicians and policymakers ensure ethical decisions are more consistently made. Drawing on the philosophical literature, we investigate the nature of trust in the patient–doctor relationship, arguing that at its core (...) it involves a transfer of discretion. We show that there is substantial empirical support for the idea that more trust will reduce the problem of too much medicine. We then investigate ways in which trust can be built, concentrating on issues of questioning, of acknowledging uncertainty and of shouldering responsibility for it. We argue that offering investigations or treatments as a way of generating trust may itself be an untrustworthy way of proceeding, and that healthcare systems should provide the institutional support for facilitating continuity, questioning and the entrusting of uncertainty. Several writers have argued that the state lacks the moral standing to hold socially deprived offenders responsible for their crimes because the state would be hypocritical in doing so. Yet the state is not disposed to make an unfair exception of itself for committing the same sorts of crimes as socially deprived offenders, so it is unclear that the state is truly hypocritical. Nevertheless, the state is disposed to inconsistently hold its citizens responsible, blaming or punishing socially deprived offenders more (...) often or more harshly than other offenders, even when the crimes are the same. The state’s stable disposition to inconsistently hold offenders responsible undermines its standing to hold offenders responsible for the same reasons that hypocrisy undermines standing; instead of making an unfair exception of itself, the state makes an unfair exception of others. Strikingly, this means that the state lacks the standing to hold anyone responsible for a crime for which it is unfairly disposed to hold citizens responsible inconsistently, not just socially deprived offenders. Thus, it is even more urgent that the state regain its moral standing by working toward a justice system that holds offenders responsible consistently. (shrink)

The impossibility theorem of Dekel, Lipman and Rustichini has been thought to demonstrate that standard state-space models cannot be used to represent unawareness. We first show that Dekel, Lipman and Rustichini do not establish this claim. We then distinguish three notions of awareness, and argue that although one of them may not be adequately modeled using standard state spaces, there is no reason to think that standard state spaces cannot provide models of the other two notions. In fact, standard space (...) models of these forms of awareness are attractively simple. They allow us to prove completeness and decidability results with ease, to carry over standard techniques from decision theory, and to add propositional quantifiers straightforwardly. (shrink)

With by far the lowest population density in the United States, myriad challenges attach to healthcare delivery in Alaska. In the “Size, Population, and Accessibility” section, we characterize this geographic context, including how it is exacerbated by lack of infrastructure. In the “Distributing Healthcare” section, we turn to healthcare economics and staffing, showing how these bear on delivery—and are exacerbated by geography. In the “Health Care in Rural Alaska” section, we turn to rural care, exploring in more depth what healthcare (...) delivery looks like outside of Alaska’s major cities. This discussion continues in the “Alaska’s Native Villages” section, which specifically analyzes healthcare in Alaska’s indigenous villages, some of the smallest and most isolated communities in the United States. Though many of the ways we could improve Alaskan health care for Alaskan residents are limited by its unique features, the “Justice and Healthcare Delivery” and “Technology and Telemedicine” sections consider ways in which certain policies and technology—including telemedicine—could mitigate the challenges developed in previous sections. The author proposes instead a program of new psychology that derives first from the relation of psychologist to his object, the human as subject; and second, from the possibilities of speech in communicative interaction. Description, whether made by oneself or by a third person, shall be substituted by speech interactions. These interactions are considered as successful when the partners in a discussion declare themselves to be understood. Within the framework of this interactionist concept, Kohlberg's and Rachael M. In this paper, I have two main goals. First, I will argue that traditional medical values mandate, as opposed to forbid, at least minimal physician participation in hostile interrogations. Second, I will argue that traditional medical duties or responsibilities do not apply to medically-trained interrogators. In support of this conclusion, I will argue that medically-trained interrogators could simply choose not to enter into a patient-physician relationship. Recognizing that this argument might not be convincing, I will then propose three further arguments (...) against the claim that medical knowledge creates special duties: the logical argument, the metaphysical argument, and the argument from analogy. Finally, I will argue that invocations of role-differentiated morality, professionalism, and oaths could not circumvent the central argumentation of this paper. (shrink)

Wittgenstein übernimmt im Tractatus das Zusammenhangsprinzip von Frege und formuliert die Doktrin von der Priorität des Satzes vor seinen Teilen, den Wörtern. Dies ist die frühste Formulierung kontextualistischen Denkens bei Wittgenstein. In der Spätphilosophie wird das "Sprachspiel" zur sinnkonstituierenden Einheit sprachlicher Kommunikation und damit zum Inbegriff kontextualistischen Denkens beim späten Wittgenstein. Eine Untersuchung der zentralen Begriffe von Wittgensteins Spätphilosophie offenbart starke Verwandtschaft zu Schapps Begriff der "Geschichten". G. Bateson führt den Terminus "Geschichte" in jenem Schappschen Sinne als Prinzip des geistigen (...) Prozesses der Informationsgewinnung bzw. Sinnkonstitution ein. Damit läßt sich über Schapps Phänomenologie der Geschichten eine Brücke von Wittgenstein zu Bateson schlagen und eine bislang unbemerkte Affinität zwischen beiden Denkern aufzeigen. Umgekehrt werden mit dem von Bateson geprägten Begriff der Transkontextualität Phänomene beschreibbar, die Wittgenstein bei der Diskussion mathematischer bzw. logischer Paradoxien behandelt. Demnach sind solche Paradoxien transkontextuelle Phänomene, die in ihrem Sinn unterbestimmt sind, ähnlich dem transkontextuellen Verhalten, das sinnbestimmende Kontexte (Sprachspiele) transzendiert und außerhalb solcher Kontexte als verrückt erscheint.
